United States Messaging Content Requirements

1) What is 10DLC ?

10DLC (10-digit long code) is a long number for business messaging in the US. 10DLC requires a special registration process and must be compliant with US messaging guidelines.

It was developed as a substitute for businesses that were using P2P numbers for A2P messaging.

2) Is there a governing body when it comes to using text messaging programs in the USA?

In the US, the CTIA is the governing body for all text messaging programs to protect consumers from unwanted messages, which all message senders must abide by, in addition to the Wireless Providers’ code of conduct and best practices.

3) For what nature of services are these guidelines applicable?

These guidelines are relevant for SMS and MMS compliance in the USA.

4) Do you need consumer consent when using SMS service?

Yes, it is required to ensure that the Consumer consents to receive text messages and understands the nature of the program. Also it is required to invite a Consumer to opt into a Messaging program and must be clearly and unambiguously displayed with the following disclosures:

  • Program (Brand) Name/Product Description

  • Message Frequency Disclosure

  • Message and Data Rates may apply (if non-FTEU)

  • STOP keyword (Opt-out information may appear in the terms and conditions.)

  • Complete terms and conditions OR link to complete terms and conditions (Popups are not a method for displaying terms and conditions)

  • Privacy policy OR link to a privacy policy

5) For what purpose is user consent required?

Messaging programs are expected to provide full transparency so that Consumers are aware of and only receive messages from Messaging Programs to which they have opted in.

  • Opt-in

  • Opt-out

  • Privacy Policy

  • Terms and Conditions

6) What are the key elements to be available in messaging flow programs?

A Messaging program’s message flow consists of the following:

  • Opt-In Confirmation

  • HELP

  • Opt-Out 

7) Are there any mandatory keyword responses to be used in messaging flow?

  • HELP messages for all message flows

  • STOP messages for all message flows

  • Mobile Terms of Service and Privacy Policy

  • Privacy Policy Best Practices 

8) What is the USA regulatory-compliant platform HRCKollect will be using for the SMS program?

9) How do we enroll for a number provisioned complied with USA program?

10DLC will be registered under the name of the customer who will be using the service. We have created a template that can be used to capture the below information, enabling HRC to submit information for approvals and get a number provisioned for a customer registered in HRCKollect.

  • Company information

  • Web URL for Terms and Conditions

  • Support contact details

  • Customer compliance officer or representative of the SMS program

  • User case – In our case it is Alerts/Notification

  • Campaign description

  • Sample messages

  • Methods used to Opt-In users in to SMS service

  • Attributes which will be used in the messaging program.
